2. Description of Service

PlaneTrack provides real-time and historical aircraft tracking data through a web interface and API. Our services include:

• Real-time aircraft position tracking
• Historical flight data
• API access for developers
• Data visualization tools

3. User Accounts

Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion.

4. Subscription and Payments

Pricing

Some features require a paid subscription. Prices are listed on our pricing page and are subject to change with notice.

Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payments are processed securely through Stripe
• All fees are non-refundable except as required by law

Cancellation

You may cancel your subscription at any time. Access continues until the end of the current billing period.

5. API Usage

Rate Limits

API access is subject to rate limits based on your subscription tier. Exceeding rate limits may result in temporary suspension of API access.

Acceptable Use

You agree not to:

• Share or resell API access
• Circumvent rate limits or security measures
• Use the API in a way that disrupts our services
• Scrape or bulk download data outside of API terms

6. Data and Content

ADS-B Data

Aircraft tracking data is derived from publicly broadcast ADS-B signals. While we strive for accuracy, we make no guarantees about the completeness or accuracy of this data.

User Content

If you contribute data as a data provider, you grant us a license to use, process, and display this data as part of our Service. Sky Shots you post publicly may be featured, with credit to your handle, on PlaneTrack's official social media channels.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Muntri LLC and are protected by international copyright, trademark, and other intellectual property laws.

8. Prohibited Uses

You may not use our Service:

• For any unlawful purpose
• To violate any laws or regulations
• To infringe upon the rights of others
• To transmit harmful code or interfere with the Service
• To collect data for unauthorized purposes
• To impersonate others or misrepresent your affiliation

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• The data will be accurate or complete
• The Service will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLANETRACK.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless PlaneTrack and its affiliates from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or prominent notice on our website. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. You agree that any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.
